| 摘 要： | 植根于中国传统文化,并在传统社会得到持续发展的调解制度,伴随着社会由传统向现代转型,其赖以存在的社会条件正在发生变化,并因此导致社会对其需求强劲而其自身功能弱化的困境。在追求法治的过程中,调解制度究竟何处何从?由于其在实现社会和谐方面具有独特的作用,因此,通过传统调解的现代转型,赋予传统调解以现代法治之品格,仍是中国传统调解走出困境,再现辉煌的唯一途径。

| Abstract: | Due to the change of social conditions, China’s mediation system is experiencing the transformation from traditional to modern, which consequently results in the contradiction between the increasing social need and the decreasing function of the system itself. What is the direction for the development of mediation system so as to play its role in promoting social harmoniousness? The answer lies in the modern transformation of the traditional mediation system, i.e. the quality of modern legal system should be attached to the traditional mediation system in order to extricate it from the dilemma. |
