| 摘 要： | 将人性、人道、人权结合起来,是刑法发展的三个层次,在这个过程中,刑法对"人"的关注程度不断增强,刑法的发展层次也越来越高.本文将这一历史发展过程展示出来,说明只有真正地将"人"的概念灌输进法律、特别是刑法当中,才能成为一部良善的法律.

| Abstract: | Combining human nature,humanity and human rights,which are the three levels in the criminal law evolution,is a process of advancement of criminal law featuring the increase of human factor in the horizons of the said law.This paper presents such historic development with a view to showing that we may ultimately have a good and just law only by gradually breathing the concept of human into law,especially the criminal law. |
