本文回顾了非洲人权法院出现的历史背景和过程 ,比较了非洲人权法院与欧洲人权法院、美洲人权法院之间的主要不同之处 ,并分析了可能制约非洲人权法院有效运作的八个主要因素。本文认为 ,如果非洲联盟能够克服这八个主要因素 ,非洲人权法院将成为非洲大陆保护和促进人权的有效监督机构 ,它将成为国际人权法中区域人权保护机制的重要角色

The African Court on Human Rights: An Important Development of Regional Mechanism for Human Rights Protection

This article surveys the historical background and process of the establishment of the African Court on Human Rights, compares the differences between the African Court and its European and Inter-American counterparts, and analyzes the eight main factors which will possibly restrict the effective operation of the African Court. It is suggested that the African Court will not become an effective supervision institution for the protection and promotion of human rights on the African continent and will not play an important role in the regional mechanism of human rights protection in international human rights law, until all of the eight factors can be overcome by the African Union.
