| 摘 要： | 传统的犯罪构成理论以对构成犯罪的各要件分析见长,但综合不够,动态研究欠缺.从动态角度研究犯罪构成非常重要,从理论角度看,它对统摄诸如形态论、转化犯等问题有意义;在实践方面,对准确地定罪量刑也有重大作用.这可从方法论、总论、分论三个方面进行分析.

| Abstract: | Conventional theories on crime composition analyze various components of crimes in a static rather than dynamic way. In fact, it is very important to study crime compositions in a dynamic way. In a theoretical sense, a dynamic study can cover various forms of crime and convicts needing transformation; in practice, it can help impose penalty appropriately. The paper gives an analysis of the components from three aspects: methodology, pandect, and sub-pandect. |
