| 摘 要： | 文章通过对出土文献、大量契约文书、民间习惯和官方规定的分析和研究指出,中国古代契约中的担保制度产生早,法律的规定和民间习惯的约定俗成相结合,人的担保和物的担保并存,尤以人的担保独具特色,形成了一个完整的契约担保体系,对保证契约制度的正常运行发挥着极其重要的作用。由于中国古代"重刑轻民"的传统,因此,在契约担保制度中,民间习惯占有十分重要的地位。中国古代契约担保制度中的许多合理性因素对于完善我国现行担保制度,具有极为重要的理论和现实意义。

| Abstract: | Through the analysis and research on unearthed documents,a vast amount of contracts,folk customs and official stipulations,it is found that the guarantee system in Chinese ancient contract was produced early,the legal stipulations were combined with the folk customs,and the guarantee of people and things coexisted,especially characteristic of people's guarantee,which formed a complete contract guarantee system and played an influential role in ensuring the normal operation of contract system.Because of the ... |
