| 摘 要： | 合同解除是否影响风险转移是国际贸易法上的一个重要问题,对这一问题的看法,学界争议很多。用历史解释、文义解释以及体系解释等方法对《联合国国际货物销售合同公约》相关条款的研究表明,合同解除影响风险转移。对德国新债法、英国法以及美国法的比较研究,也得出合同解除影响风险转移的结论。因此,合同解除影响风险转移是一项比较确定的规则。
