| 摘 要： | 意思自治原则的适用范围应加以扩大。意思自治应该是有限制的、相对的，但采用唯一选择的意思自治规则违背了意思自治的本质。意思自治条款应体现约定的优先适用性。为保护受害人的利益，应由法院在一定范围内选择对受害人最有利的法律或限制对需要特殊保护的一方当事人不利的法律选择。

| Abstract: | The scope of party autonomy principle should be extended.Choice by the parties should be relative and limited,but adopting the only choice of Party Autonomy Principle is against its nature.The items of Party Autonomy Principle should show the precedence of the agreement.To protect the benefit of the victims,in certain areas the judges should choose the most beneficial rules to them or limit the harmful choice to them. |
