| 摘 要： | 非物质文化遗产权利主体的确定是法律保护中的难题，理论研究与立法实践均未形成统一的方案。通过对非物质文化遗产权利主体不同学说的评析，依据非物质文化遗产形成和传承的客观规律、相关国际公约的规定及我国的司法实践，提出应确立非物质文化遗产来源群体与传承人二元权利主体模式。借鉴物权法中建筑物区分所有权的理论，确立非物质文化遗产区分所有权理论，即非物质文化遗产中的精神权利由来源群体共有，传承人对其所持有的非物质文化遗产享有独立的财产权利，对其基于所持有的非物质文化遗产自我创新的智力成果享有知识产权。
