| 摘 要： | 现实主义法律运动是对法律形式主义的一种反动和纠偏。文章通过历史性、比较性、语义分析等研究方法，认为法律现实主义对于当时急速发展的美国社会所暴露出来的问题及时地给予回应，其对法律形式主义的批评可以概括为对法律确定性的怀疑，而怀疑的重心又归于现实主义者们洞悉到在司法过程中“人”的因素的客观介入和不可小觑，即归于司法过程中法官自由裁量权的运用和影响，并且“新”的更为真实的法律确定性正是存在于其中。当我国的法律规则日臻完善之后，我们需要借助现实主义法律运动的观点及时地将中国的法制建设推进到“下一步”，即关注法治中“人”的因素，加强法律职业共同体建设。
