论经济法的经济性--与经济法社会性之考辨

经济法的属性研究必须应当建立在一定的标准之上,援引近临相关学科的基本范畴,从不同的角度对经济法的独立性和科学性予以审视,在同属于法律规范的范围内探讨部门法律属性,应当遵循“厚特殊轻一般”的原则。经济法的属性即是如此。我们不怀疑经济法的社会性,但不赞同将社会性作为经济法的独立属性予以探讨。相反,从经济法的逻辑起点到经济法的价值归宿都在彰显其独立于其他部门法的经济性。

ECONOMIC NATURE OF ECONOMIC LAW

The research in economic nature of economic law should be referred to a series of standards,adopting the fundamental concepts in relevant social sciences and scrutinizing the independent and scientific nature of economic law.Debating on the natures of different laws in the same scope we should abide by the principles of highlighting specialties and disregard common natures.We should not put doubt on the social nature of economic law,but simultaneously disagree to take it as an independent one.Instead,economic law embodies the economic nature from logical setting points to valuable goals hereof.
