| 摘 要： | 阐述政府与人权的现代含义 ,进而论证二者的关系 :人权先于政府而存在 ;政府是或应是人权保障的工具和手段 ,人权是或应是政府权力运行的最终目的。在现实生活中 ,政府与人权的关系又具体表现为权力与权利的关系 ,基于权力的扩张性和权利的易受侵害性 ,实现人权则对政府实施权力控制
