“公正与效率”向度中程序成本的司法分配——兼论诉讼代理费的司法分配

公正与效率是我国司法制度改革的基本价值取向 ,追求公正与效率的程序建构引起了程序成本的变动 ,司法对公正与效率向度中程序成本特别是诉讼代理费应当予以司法分配。因此 ,加强公正与效率向度中的程序成本分配研究 ,实现程序成本合理配置而获取最大化正义的实现 ,是当前诉讼制度改革研究的重要内容 ;为此就必须探讨程序成本变化的原因和流向 ,设计程序成本变化后的再分配规则 ,建构诉讼代理费的分配方案等。

Judicial Allocation of the Procedural Cost among Justice and Efficiency

To pursuit justice and efficiency, being regarded as basic value of judicial reform, have made procedural cost change. Judicial trial must distribute it, especially on advocative fee. This paper discusses the original reason and developing orientation about changes of the procedural cost, provides redistibution plan, reconstructs allocative program on the advocative fee.
