| 摘 要： | 土地流转是目前学界研究新农村建设的一个重要课题,许多学者认为产权制度是影响土地流转的重要因素。然而,土地产权仅仅是一种外部制度性原因,而影响土地流转的内部根本原因是村落的乡土秩序。本文通过对浙江省Z村一带土地流转的田野调查,试图超越土地产权的解析,而用情景性合约这个概念来揭示土地流转中乡土秩序的作用机制,阐释一种由共同体意识和人情的运作等因素在社会时间和空间的延展中交织和碰撞后所呈现出的动态的非均衡实践。
