论沈家本的法学思想

沈家本是中国近代法学的奠基者。他在 30年的法律实践过程中 ,积累了深厚的传统法学功底。同时 ,他思想开放 ,虚心学习西方近代法学理论 ,融会贯通 ,形成了自己的法学思想。他在法学理论、法学研究方法、法学实践等方面都提出了与中国古代法学1有质的区别的新思想。这些思想对扭转长久以来知识界轻视法学 ,忽视法学教育的风气产生了重大的影响 ,推动了我国法学的近代化。

On Sheng Jia-ben's Thoughts of Law

Shen Jia-ben is one of the outstanding founers of China's modern science of law.During his thirty years legal practice,he accumulated profound traditional knoledge of law.Meanwhile,he was open to the world and he had unpretentiously learned about the western modern law theories.On the basis of these two aspects,he developed his own law thoughts,such as law theories,law research methods and law practice,which are different from China's ancient law thoughts.All these ideas which promoted the modernization of Chinese law changed the atomasphere of ignoring the scienct of law and law education among the intellectuals.
