从传统法律的中立价值到价值中立的法律传统

在中国文明传统从边陲向中央世界的迈进过程中,中国法律界的主要任务,是重新把握和研究中华民族传统文明及其法律道路问题。但是,在一个已经瓦解了神圣性的传统价值中,问题不在于功利主义或者实用主义的短视,而在于忽略了我们历史文化传统中最为深层的东西。因是之故,有必要将中国法律理论的研究放到一个大的文化背景中,放到大的法律发展史的框架中来研究,有必要根据中国传统文化的发展脉络及其内在精神来研究,要从这些根本中提炼出更为根本的东西,用来构建中国本身的法律发展理论。从本质上来说,中国社会的发展确实也需要这样一种具有相当阐释力的传统理论作为思想运动之基础。准此而言,如果我们尚有能力通过技术化的细节处理来完整的表现思想史的体系以及精微之处,并由此形成一种思想史研究的风格,则不啻是一种伟大的贡献。所以,我们更需要一种新的方法或者范式来直入传统之门径。
