民事诉讼保全的类型化分析

2012年8月31日修改的《民事诉讼法》第100条新增行为保全制度,填补了以行为给付为保全对象的制度空白,丰富了保全制度的内涵与外延。但第100条文义不足以涵括行为保全的样态。此外,行为保全与财产保全,根据功能、目的和采取措施的不同,又可以作进一步类型划分,《民事诉讼法》在制度安排上未对保全进行类型化区分,适用中易滋流弊,亟待完善。

A Category Analysis of Preservation in Civil Procedure Law

A new legal system called Behavior Preservation was added to Article 100 of the 2012 revised Civil Procedure Law, thus filling a systemic gap concerning behavior preservation and enri- ching the denotation and connotation of preservation system. Nevertheless, the wording of Article 100 is too brief to cover the various forms of behavior preservation. What＇s more, property preservation and behavior preservation can be further categorized according to function, purpose and measure. But the Civil Procedure Law fails to make any distinction of the different types of preservation, so it will give rise to errors in judicatory practice and must be improved.
