| 摘 要： | 矿产资源蕴藏在自然环境中,属于自然环境资源的一部分,矿产资源开发利用必然会影响环境。本文分析了我国矿产资源开发利用权益市场化配置中缺乏与其配套的、有效解决环境问题的环境权利保障制度所产生的严重后果,进而运用环境权理论剖析了矿产资源开发利用中环境权利的体系构成、类型、特点及其环境权利保障制度的功能,最后提出了矿业权市场化配置中环境权利保障制度设置的基本原则。

| Abstract: | Mineral resources lie in the natural environment. The tapping and utilization of the mineral resources must affect the natural environment.This paper analyzes the aftereffect which results from the absence of environmental right safeguard system in the market disposition of mining right, and makes clear the frame, the types and the character of the environment right, and the function of the environmental right safeguard system. Also, it puts forward the fundamental principle of setting up environmental right safeguard system in the market disposition of Mining Right. |
