论农业经济立法价值分析

中国农业在进入市场经济与加入WTO后,面临着制度建设的严峻挑战。我国的农业建设很长时间内主要是依赖政策来调整,与国家法律和外部制度环境存在差别,如何依法治农,确立中国农业经济立法价值,对新的历史时期农民增收具有重要意义。在农业立法中,首先要解决好政府与市场的关系,实现增长与公平兼顾,克服农业经济领域中的法律拒斥现象。

Analysis of Legislation Value of Agricultural Economy

Agriculture of China is confronted with fierce challenge after its entry of market economy and WTO.The agricultural construction has long depended on its policy adjustment,great difference has been found between the national law and the external system.It is of great significance to establish its legislation value and increase the peasants' income in the new historic period.During its process of law making,the relationship between the government and market should be properly solved,the balance of growth and fairness should be well maintained,and the law rejection phenomena should also be eliminated.
