法社会学中国化研究的理论自觉——兼评高其才教授的《法社会学》

法社会学存在“中国化”问题。作为高其才教授的一部法社会学著作，《法社会学》通过实证研究探讨了中国社会的法律实践和理论问题。其关注到法社会学中国化的意义并对之进行了努力，体现了中国法社会学学者进行法社会学中国化研究的理论自觉。通过进一步研究就能够继续回答法社会学中国化这一问题：中国法社会学发展方向是法社会学中国化，法社会学中国化的主题是法社会学本土化。只有深化法社会学本土化研究，才能探索出中国自己的司法改革路径。

On the theory consciousness of the sinicization of law-sociology research --comment on Law-Sociology written by professor Gao Qi-cai

There exists a problem of ＂sinicization＂ in the study of law-sociology. As one of the works on ＂law- sociology＂ of Professor Gao Qi-cai, Law-Sociology looks at the issues on the legal practice and theory of Chinese society by the empirical study, which concerns the meaning of law-sociology sinicization, and makes the great efforts on it to embody the theory consciousness of Chinese scholars of law-sociology in their research of the sinicization of law-sociology. Through the further research, we can answer the question of the sinicization of law-sociology, which is the direction of law-sociology in China. The topic of law-sociology sinicization is law-sociology localization in China. So only through deepening the research of law-sociology localization in China, will we be able to explore the way of China＇ s judicial reform.
