| 摘 要： | 在监护领域内出现的私人监护人是一个相对较新的现象。以往成年监护制度对欠缺行为能力成年人的保护停滞于家庭、亲属或者公共监护。但随着以社会为本位的福利国家构建的开展，现代监护法应逐渐认可私人力量对成年监护的适当介入。但私人专业监护人介入私法领域的同时引起了美国社会的广泛关注，私人专业监护过程中的利益冲突、保险和担保制度、报酬支付以及信誉问题成为美国当今学界探讨的热点。而这些探讨则对我国具有重要的借鉴意义。
