| 摘 要： | 国际法与国内法是相互联系的两个法律体系 ,这种联系的表现之一就是国际法在国内的适用。从我国实在法的角度考察国际法在我国国内的适用 (效力 ) ,国际法在我国国内法上具有效力 ,可以适用 ,但在具体适用条约和国际习惯方面 ,我国宪法在立法层次及效力方面没有相应的规定。我国宪法应该明确规定国际法与我国国内法的关系 ,首先明确我国对国际法的原则立场 ,其次要明确国际法在我国的适用

| Abstract: | International law and national law are two legal systems which connect each other tightly.From the aspect of our national law,international law can be applied,but how to apply the treaty law and custom law is still under question,and we have no rules of application. We must regulate(stipulate) the relation of international law and national law in our Constitution. |
