对健全中国科技咨询业法律规范的思考

中国的现代咨询业经过20多年的探索与发展已走上健康发展的道路,并初步建立起 "先咨询、后决策"的体系,但与发达国家规模庞大的科技咨询业相比,还存在较大差距。 文章分析了中国科技咨询法律规范的发展过程以及体系建设的基本情况,从完善行业法律法规、政策制定,分清行业层次、明确职业资格认证和考核制度等方面提出了如下建议:建立和完善科技咨询业执业资格认证制度;统一行业合同示范文本及规范;建立行业信誉评估体系;树立从业人员道德准则;建立行业统计指标体系;加强政府对咨询业的宏观管理等手段,健全和完善中国科技咨询业的法律规范体系。

Considering on Improving the Law Criterion of Chinese Science and Technology Consultation Industry

Chinese modern consultation has developed healthily through more than 20 years- exploration, and has initially established "first consults, the decision-maki ng" system, but compared with the huge scale of the consultation in developed c ountries, it also has a bigger disparity. The article analyzes the developing pr ocess of law and standards of Chinese science and technology consultation as wel l as the basic situation of system construction, from aspects of improving consu mmation professional laws and regulations, formulating policies, distinguishing professional levels, clearing about qualifications authentication and system of examining and assessment. The author proposes that a master qualifications authe ntication system of the consummation science and technology consultation industr y should be established, professional contract demonstration text and standards should be unified, professional prestige appraisal system and the jobholders mor als criterion should be set up, the profession system of statistical indicators should be established, and the government macroscopic management of consultation industry should be strengthened, so as to improve Chinese science and technolo gy consultation industry law standard system.
