| 摘 要： | 检察官制度的建设是法治建设的重要方面。中国的检察权是来源于国家权力机关的独立于立法权、行政权、审判权的一种专门的法律监督权。检察权的性质决定了检察官的性质、职业特点和职权配置的内容。我国学界存在一种观点，即简单地把检察官视为行政官或司法官，这种观点没有从我国检察权所包含的特有属性入手分析问题，因此它不符合中国的政体和现行法律体制。

| Abstract: | In strengthening the lawful system,the construction of procurator system is significant.The procuratorial power of China,independent of the legislative power,executive power and jurisdiction of the state-power administration,belong to a special superintendence.And its quality decides the procurators' quality,professional feature and functional allocation.In Chinese academia,there is a saying that procurators are simply administrators or law-officers,which,without analysis of peculiar attributes contained in China's procuratorial power,does not accord with our polity and current legal system. |
