试论经济法责任的独立性

经济法是国家协调或干预经济运行的各种行为的独立的法律。根据目前法律责任按部门法划分的原则，经济法责任是以一种动态发展和综合的形态独立存在的。考察了经济法独立存在的历史必然，论证了经济法责任关系的独立性，进而论证了经济法责任不因责任方式的借鉴性而失去独立性。而且基于我国市场经济法治状况及其经济法责任实现的难度，论证了经济法责任独立存在的必要性，并简单设计了基本框架。最后，探讨了经济法责任的诉讼实现机制，提出了若干设想。

On the Independence of the Liability of Economic Law

Economic law is an independent legal branch to regulate government's coordinating or intervening behaviors in economic operation. According to the principle of classifying legal liability by branch, the liability of economic law does exist independently in the form of dynamic development and integration. In this paper, the historical necessity for the independent existence of economic law is reviewed, the independence of liability relationship of economic law is discussed, and the view that this independence does not disappear with new forms of liability is proved. In view of the legal condition for market economy in China and the difficulty in achieving the liability of economic law, the necessity for the independence of the liability of economic law is discussed and a simple framework is designed. Finally,an explorative discussion is made of the mechanism for implementing liability litigation of economic law and some tentative ideas are put forward.
