侵害公民土地使用权行为认定及赔偿新探讨

《中华人民共和国土地管理法》规定，公民依法登记的土地的所有权和使用权受法律保护，任何单位和个人不得侵犯。形成侵权赔偿的前提条件之一，就是土地使用权被侵害且造成了经济损失。侵害公民土地使用权的行为，有来自于出让合同、土地使用权转让合同、土地使用权出租合同中的侵权行为，也有来自于不正当的行政干预行为，尤其是对“四荒”拍卖过程中的侵害土地使用权行为，必须依法认定侵害土地使用权的侵权责任构成，甄别侵权责任人或单位。构成侵害公民土地使用权的必须依法赔偿，同时还应追究责任人的经济责任、行政责任或刑事责任。

More Study on the Confirmation and Payment for Infringing Citizens'Land Rights

The Law of Land Managemont of the People's Republic of China stipulates that citizen's ownership and right to use the land they have registered according to law are under the protection of the law,and that no unit or individual is to infringe upon them.Redress for tort should be based,among other things,on violations of land rights rusulting in economic losses.Such violations may come from letting of contracts,tranfer or renting out of land rights,and improper administrative intervention.Violations of land rights that occur in the auctions of mountain or river wastes,in particular,must be confirmed by law to make out the violaters,whether they may be individuals or their work_units,and compensations for their violations must be made according to law.In addition,investigations should be made to find out those who are to answer for their violations economically,administratively or criminally.
