我国《物权法》不动产登记效力之评析

我国《物权法》规定了四种不动产登记效力,即,作为不动产物权变动要件的效力、登记对抗力、登记推定力和不动产物权善意取得效力,这在立法上是一种大的进步。但是,《物权法》关于这四种效力的规定也存在一些不足。未来应当通过实行统一的不动产登记制度,取消登记对抗主义等措施,保障和提高不动产登记簿的正确性,进而在物权法中明文规定登记推定力和扩大登记公信力的适用范围。

Reviews on the Effectiveness of the Registration of Realty in the Real Right Law of China

According to the Real Right Law of China,the registration of realty may have four kinds of effectiveness,that is,bertragungswirkung,the effectiveness to challenge any third party,Vermutungswirkung and Gutglaubenswirkung,which is a good progress of the Real Right Law of China.However,the rules concerning the four kinds of effectiveness still have some defects.In future,some measures,such as to practice a uniform registration system over realties and to abolish the registration effectiveness to challenge any third party in real right law,should be taken to ensure and to raise the accuracy of reality registration,and then,in Chinese real right law,to stipulate a rule of Vermutungswirkung and enlarge the scope within which the rule of Gutglaubenswirkung may be applied.
