我国农民工土地权益法律保护探析

当城镇用工环境或国家相关政策发生变化时,农民工返乡现象增多,他们便会重新要求其土地权利(承包经营或居住),致使村内已有的人地关系产生了新的矛盾。为解决这类矛盾,在分析其制约因素的基础上,可以从保障农民工的土地权利并将其转化为财产权利、规范宅基地流转行为、完善相关的法制建设与社会保障制度等方面维护农民工的土地权益。

Studies on Land Rights Law Security of Farmer Workers

The problem of farmer worker rights security has been focus in society. Though there are many studies on their working and living conditions in city and town, few pays attention to their land rights. Once circumstances or policies change, more farmer workers will come back to village, then they must reclaim their land rights(contract-manage and living), and bring new problem on relation of peasant and land in the village. For solving this kind of conflict and protecting land rights of farmer worker, on basis of analysis restrict factors we can think about transforming their land rights to property rights, establishing living land transfer standard, perfecting related law and social security system.
