| 摘 要： | 合同法不仅应该保障交易安全,还应该降低交易成本,以促进交易,但合同法的这一功能在理论上和实践中受到忽视。合同法有较多路径降低交易成本,但也存在较多因素对交易成本降低构成限制,其中以交易安全方面的限制最为严重,因此需要寻求一个交易成本与交易安全之间的均衡点,以实现其应有的功能。

| Abstract: | Contract law should not only provide transaction equity,but also reduce transaction cost s o as to promote transaction business.However,this function is ignored in the l egal theory and practice.There are many ways of reducing transaction cost in co ntract law,but there are also many restricting factors.Therefore,we should seek a point of equilibrium in order to give full play to the function of the c ontract law. |
