电子商务的发展与民商法的创新

电子商务作为一种新型的市场交易方式,在给社会带来无限商机、促进经济效益快速增长的同时,也使调整现代市场交易关系的民商法律规范受到极大的挑战,因此民商法必须实行变更与创新,赋予新型民商事主体的法律地位,制定形式意义上的电子商务法或对传统民商法律规范作出修改,并注重与WTO规则和国际通行规则相衔接,以回应这种挑战。

Electronic Trade & Civil Law

The electronic trade, as a new trade style, has issued a great challenge to the civil law which regulates modern trade relationship, while creating enormous trade opportunity to the whole society to push economic benefit increase fast. Therefore, the civil law must be perfected and innovated to admit the legal status of new style civil subject, and we must draw up a independent Electronic Trade Law or amend the traditional Civil Law. At the same time, we must pay attention to make it corresponds to the WTO regulations and the intentional practice to respond the challenge.
