论信托法的创新功能及其司法裁判尺度之统一

《信托法》在我国已实施十三年，但是信托制度应有的创新功能及其对社会经济转型发展的推动作用尚未能得到充分发挥，其中司法裁判对信托创新交易行为的立场混乱是重要原因之一。本文通过对我国《信托法》实施以来得与失的理论评价、对实践中常见的信托创新活动类型的考察、对世界范围内信托创新发展及司法裁判逐步宽容的历史回顾，多角度地论证了信托法的创新功能；在此基础上梳理了近期我国有关信托纠纷的典型案例，指出当前我国司法机关对信托创新交易的裁判尺度极其混乱的现实问题，并结合实践中常见的信托创新交易类型及近期典型案例，深入剖析了司法裁判的具体评价方法，以期为司法机关统一信托创新交易的法律适用提供切实可行的法律思路。

On Innovation Function of the Trust Law and Unification of the Judicial Decision Scaling

The ＂Trust Law＂ has come into effect for thirteen years in our country, but its innovation function and role in promoting social and economic transformation and development has not been brought into full play. Tracing it to its source, confusing scaling of the judicial decision on innovation transaction behavior of trust is one of the important reasons. This paper first argues for the innovation power of trust from several angles, namely, theoretical evaluation of the achievement of our country＇s implementation of the trust law, investigation of the types of innovation activity of trust in practice and review of international trust innovation development and increasing adjudication tolerance. Then, it sorts out recent typical cases of trust dispute in our country and points out the problem of extremely disordered scaling of the judicial organs on the innovation of trust transaction. Finally, combined with the common types of innovation transaction of trust in practice and recent typical cases, the paper makes an in - depth analysis of the specific methods of judicial judgment evaluation, in order to provide judicial organs with unified legal application on innovation transactions of trust.
