| 摘 要： | 外籍律师作为晚清时期中国境内的一个特殊法律职业群体,其对华洋纠纷和诉讼的参预活动,具有明显的职业化趋向。这种职业参与,一方面有利于华洋纠纷的解决,且在一定程度上成为中西方法律对极中的粘合剂;另一方面,他们作为一个新生事物在中国法律生活中的出现,同样也加深了国人对律师功能的体认,有利于国民权利观念的激发,并为近代中国律师制度的建构提供了良好的垂鉴。

| Abstract: | Foreign lawyers were a special legal professional community in later Qing Dynasty,their participation in the disputes and lawsuits between Chinese and foreigners,had an obvious professionalism trend.This kind of occupation participation,on the one hand was advantageous to the solution of disputes between Chinese and foreigners,also became the bond of the law of Chinese and the Westerners which was antipode in the certain degree;On the other hand,as the newly emerging things in Chinese law life,they similarly deepened Chinese realizing to the function of lawyer,it was advantageous to stimulate the national right idea.In addition,they had provided a good model for the construction of lawyer system in modern China. |
