| 摘 要： | 审判实务中,知识产权恶意诉讼日益严重,这些行为不仅浪费了司法资源,而且严重侵害了诉讼相对方的合法权益。规制知识产权恶意诉讼,应在《民事诉讼法》中明确规定民事诉讼活动应遵守诚实信用原则,同时应建立法官依职权主动采取的程序机制和当事人提起诉讼的损害赔偿机制。
