宪法变革与民营经济的发展

宪法变革与民营经济共同经历了一个波浪式的前进过程 ,以新制度经济学为理论视角 ,探索我国宪法变迁与经济转型、民营经济发展之间的关系 ,是法学和经济学的重大课题。民营经济为市场经济体制奠定了坚实的微观基础 ,对于以法治为基础的市场经济制度的需求日益增大 ,直接推动了宪法变革。民营经济的进一步发展和市场经济的成功转型最终有赖于宪政制度基础的完成 ,我国必须以主动的宪法变革促进民营经济的健康发展。

Constitutional Changing and the Development of Private Economy

Constitutional changing undergo a wave-like course of development, together with private economy. In the view of new institutional economics,a common important task of theory of law and economics is exploring the relation between constitutional changing and transition of economy. Private sector has established solid microcosmic groundwork for market economy, put forward increasingly demands for institutions based on rule of law, and promoted constitutional changing straightly. More evolution of private economy and success of transition of economy will rely on an accomplished base of constitutional government. We must carry through constitutional reform initiatively to facilitate private economy growing healthy.
