| 摘 要： | 伊拉克战争以后,战俘的待遇及虐待战俘的国际责任问题成为了国际社会和国际法广泛关注的热点问题。虐待战俘行为既构成行为人及其指挥者的战争罪行,也应构成国家的极其严重的国际不法行为,因此,“虐俘”行为既产生直接行为人及其指挥者的国际刑事责任,也产生了国家的严重的国际责任。作为战俘的国籍国,可以通过外交或司法途径要求战俘的控制国承担其国际责任,也可通过国际刑事法院或国内法院追究直接行为人及其指挥者的国际刑事责任。

| Abstract: | Maltreatment of POW is a war crime of actors and their commanders.Maltreatment of POW is a gross international wrongful of the state.So maltreatment of POW results in international criminal responsibility of actors and their commanders and aggravated international responsibility of the state.The state of POW can ask the state controlling POW to bear international responsibility through diplomatic and judicial way.Meanwhile the state of the POW can investigate the actors and their commanders into international criminal responsibility. |
