| 摘 要： | 追及效力与善意取得均为物权制度设计之必须,两种制度在发生冲突时如何平衡,历来为各国民法所关注并力求寻找解决的途径。针对该问题,阐述了两种制度冲突平衡机制的构建,分析论证了两种制度冲突平衡机制的价值取向,提出了与平衡机制有关的疑难问题及立法建议。

| Abstract: | Overtake potency and the obtain with good Intentions both are the necessary consideration of designing real right system,when two systems happen to conflict,the solvent is always the attention of civil law of every countries.According to this point,this paper expatiate the balance system construct of two systems,analyze and discuss the value tropism of balance of two system,put forwards to the difficulty questions and legislation of balance system. |
