集体谈判和集体合同制度的作用及其推行

摘    要:在当前深化企业产权制度改革的进程中,我国劳动关系呈现紧张状态,因而推行集体谈判和集体合同制度、发挥其协调稳定劳动关系的作用显得尤为重要。然而在目前推行上述制度的过程中存在着相关劳动立法不健全、工会职能发挥不好以及群体认识、习惯和实践经验缺乏等问题,据此认为,政府、工会,企业三方应在劳动立法、工会制度改革以及相应的集体谈判组织建设等方面发挥各自的作用,共同推进集体谈判和集体合同制度的实行。

Abstract:In the current deep-going reform on property system in enterprises, a tension in the present laboring relations has occurred in our country, so it is important to implement collective-based negotiations and contract system, whose rolls are to coordinate and stabilize the relations. However the problems are faced in the process: lack of corresponding laws, deficiency of trade union functions as well as inadequate community awareness, custom and the experience. As the result, the paper points out that the tripartite function should be together made by the government, trade union and enterprises.
