| 摘 要： | 以情势变更、显失公平为典型的公平规范的根本功能,在于为非自由状态下理性不足的缔约人设置契约退出机制,并非以结果不公平为救济基础。公平规范实为保障契约自由实现的制度条件,而非对契约自由的限制。

| Abstract: | The basic function of equity norms in contract law such as change of situation,obviously unfair,is to set up a mechanism of quiting from the contract for those contractors who,under the circumstances of under freedom,do not have enough reason,but not a remedy system based on unfair result.Equity norms are institutional conditions of realizing freedom of contract,but not the limitation to it. |
