农民宪法权利平等保护的正当性

正当性具有多维视角,以人的尊严为标准的正当性才是绝对的正当性。我国农民宪法权利在制度和实践层面都没受到平等保护,其根源于在特定历史条件下对国家行为的指引和评价采取的是相对正当性观念。新的历史时期,平等保护农民宪法权利应在人的尊严视域下,以诠释学的方式解读宪法文本,通过宪法实施消除具体制度设计中的不平等因素,保证制度正当性;在实践中则以确保农民的主体地位,实施以权利为基础的发展范式和加强国家对农民权利的保障等方式实现实践正当性。

On the justification of securing the Chinese farmers' constitutional right

The definitions of justification are various,and only the one encompassing the human’s dignity is convincing.So far,the Chinese farmers’ constitutional rights are not properly acknowledged,which originates from history.At present,the inequality reduction and justice call for a new interpretation of the Chinese Constitution so as to protect the farmer’s constitutional rights.In practice,more effort should be made to improve the farmer’s social position and defend their rights.
