| 摘 要： | 文章以诉讼法学的“举证责任理论”作为出发点,反思了我国侵权行为法理论的不足,并提出了修正意见。文章认为,在侵权行为内部,各法律要件之间是以一定层次结合在一起的。在具体案件的审理过程中,法律要件事实的举证责任也是依次出现的。

| Abstract: | Based on the theory of Burden of proof,this article analyses the structure of torts and the torts law of China.With the analysis,it points out: since torts consists of several elements in a way of layers,burden of proofs to the elements of torts should emerge one after another,during hearing of a tort case. |
