我国合同立法引入效率违约制度可行性探析

效率违约制度是以理查德·A·波斯纳为代表的经济分析法学派提出的一种违约理论，鼓励人们在违约收益大于履约收益的情况下违约，从而实现效益最大化。我国《合同法》恪守大陆法系“契约必须得到遵守”的传统．没有引入效率违约，违约责任的首选方式是实际履行，在实践中造成了一些困境。本文通过对效率违约制度的介绍，探究效率违约制度的理论基础，从而分析在我国建立效率违约制度的可行性，希望在《合同法》修改时能引进效率违约制度，从而促进我国违约责任制度的完善。

On the Feasibility of Efficient Breach of Contract in Legislation of Our Country's Contract Law

The system of efficient breach of contract is the theory of breach of contract,which is posed for Richard· A·Posner who is the commissar of the Jurisprudence of Economic Analysis. The system is to encourage people to default the contract when the value of default the contract is larger than the value of implementing the contract. The purpose is to maximize efficiency. Our contract law observes the civil law system,in which the contract must be obeyed,but the law can’t recommend the system of the efficient breach of contract. In general,the responsibility for default the contract is to perform the contract,but in the practice there are some difficulties.Firstly,the article is to introduce the system of efficient breach of contract,second,and then explores the theoretical basis of the system of the efficient breach of contract,thereby we can analyze the feasibility of the system in our country,to find the land for construction of the system of the efficient breach of contract. We hope we can recommend the system of efficient breach of contract when the contract law is emended,to perfect our country's system of breach of contract.
