| 摘 要： | 随着交易的发展和通信工具的改进,越来越多的人利用传达者来传达信息。但传达者的传达往往会出现错误,而我国合同法又只规定了合同当事人双方在合同订立及履行过程中的责任,却没有规定传达者的责任,这无疑是一个立法上的疏漏。因此探讨这一问题对于完善我国的合同立法十分必要。

| Abstract: | Along with the development of trades and the improvement of communication devices,more and more people are using messenger to deliver information.But the transmission of the messenger usually turned wrong,and the law of contracts in our country only made regulations for the duty of the two parties during the course of the signing and implementation of the contracts,didn't regulate the responsibility of the messenger,this undoubtedly is a flaw in legislation.Therefore,the discussion of this problem is very necessary for the perfection of our country's legislation of contracts law. |
