| 摘 要： | 知识产权法和行政法规或措施是保护非物质文化遗产的必要措施,但刑法的保护作用不应被忽视。刑法通过知识产权罪刑规范和附属刑法规范为非物质文化遗产提供保护。该文认为应完善我国刑法中侵犯知识产权罪的罪刑规范和非刑事法律中的附属刑法规范,以更好地发挥刑法保护非物质文化遗产的作用。

| Abstract: | Though Intellectual property law and administrative statute are essential measures,criminal law should not be ignored.Intangible cultural heritage has been protected by the intellectual property crime regulations and the affiliated criminal law.We should perfect the intellectual property crime regulations and the affiliated criminal law to protect intangible cultural heritage. |
