| 摘 要： | 违约金与赔偿损失责任都为补偿损失功能,在同一违约事实中不能同时适用;且在约定了违约金责任的情况下,只能适用违约金责任,不能再主张赔偿损失。只有在实际损失过分高于或低于约定违约金时,基于当事人请求,法院才可以调整违约金。

| Abstract: | The penalty has the same function of compensation as the compensation loss,but it can not be applied at the same time on the ground of breach of agreement.And in the agreed penalty responsibility situation,it can only be suitable for the penalty responsibility,and cannot advocate the compensation loss again.Only in condition that the actual loss is higher or lower than the agreement penalty excessively,the court adjust the penalty based on the litigant s. |
