论从实际出发与立法

从实际出发是研究立法学的基本方法之一。从实际出发是建立社会良性秩序的内在需要，是立法的基本出发点和着力点，也是立法的归属。实施立法的必要条件和现实条件取决于人们共同理念和利益的需要。立法可发挥作用的程度，在于立法者发现和满足这种共同理念和利益程度以及其要求法律变化的程度。立法者只有从实际出发，不断提升立法水平，才能完成立法的使命。

One of the fundamental methods to study the legislation is to put it into an act based on current circumstances.It is a starting point,a key as well as a desired result for legislation to establish a good social order.The pre-requisites of the implementation of legislation depend on the common thoughts and common interests of people.Whether the legislation can be further effective depends on how the legislators meet these common thoughts and interests.Legislators should always be down-to-earth and constantly improve legislation so that the legislators' mission could be accomplished.
