| 摘 要： | 在介绍图书馆数字化建设中有关知识产权问题的各种法律法规后，着重分析了合理使用和法定许可原则，指出必须加强立法，尽快制定图书馆法，以及强制许可制度及版权补偿金制度，同时要完善和加强著作权集体管理机制，为中医院校图书馆的发展和数字化中医药文献的版权保护提供一些法律依据。

| Abstract: | With an introduction to the various laws concerning intellectual property rights law in the construction of digital libraries,the author deals mainly with an analysis on the principles of rational use and legal permission.The author also points out that efforts should be made in enhancement of legislation including laws for libraries,compulsory license system and copyright compensation system.Meanwhile,it is also necessary to perfect and strengthen copyright collective management system,so as to provide legal basis for the development of libraries of TCM colleges and universities and the protection of copyright for digital TCM literature. |
