基于美式模板和欧式模板下中国数字贸易规则体系的构建

近年来,全球数字贸易发展迅猛,然而贸易规则却远滞后于经济发展速度。纵观世界各国,美国和欧盟数字贸易发展最早,也逐渐形成了两大典型的数字贸易规则模板,并引领着全球规则走向。文章通过对两大模板的特征分析,叙述了两大模板存在的主要分歧,即数据本地化、跨境数据自由流动、隐私保护及网络中介责任认定,并针对主要分歧探究中国数字贸易规制的发展趋向,同时提出一些建议。

Construction of China's Digital Trading Rules System Based on American Templates and European Templates

In recent years, the global digital trade has developed rapidly, but the trade rules lag far behind the speed of economic development.Throughout the world, the United States and the European Union digital trade development is the earliest, but also gradually formed two typical digital trade rules template, and led the global rule direction. Based on the analysis of the characteristics of the two templates, this paper describes the main differences between the two templates, that is, data localization, cross-border data free flow, privacy protection and the identification of network intermediary responsibility, meanwhile, some suggestions are put forward.
