法教义学视角下信用利益之损害赔偿责任研究

信用利益侵权损害赔偿已成为实务中的多发问题,现行民法对此却未设明文。通过对比观察我国司法实务判决可知,法院在对待信用利益侵权纠纷上存在较大分歧,且现有的以名誉权、姓名权、一般人格权为裁判依据的信用利益保护路径难以实现对信用利益的妥当保护。因此,有必要从请求权基础、责任构成要件、损害赔偿范围等方面重构信用利益之侵权责任。在现行实证法体系下,以《侵权责任法》第2条2款规定作为信用利益保护之请求权基础,并在此基础上逐一检讨侵权责任构成要件,从而确定损害赔偿范围,可资为信用利益保护的最佳进路。

Research for Liability for Damages of Credit Interests from the Perspective of Dogmastics of Law

Credit compensation for infringement of credit interests has become a frequent problem in practice, but the current civil law does not have a clear text. By comparing and observing China''s judicial practice judgments, the courts have great differences in dealing with credit interest infringement disputes, and the existing credit interest protection path based on reputation rights, name rights and general personality rights is difficult to realize credit interests being properly protected. Therefore, it is necessary to reconstruct the tort liability of credit interests from the basis of the right to request, the elements of responsibility, and the scope of damages. Under the current system of empirical law, the provisions on fault liability in Article 6(1) of the Tort Liability Law are used as the basis for the claim of credit benefit protection, and on this basis, the elements of the tort liability are reviewed one by one, thereby determining the scope of damages, which is the best way to protect your credit interests.
