摘    要:儒家法律思想不是前人所说是为人治,它是儒家先人在充分理解人性的基础上而构建的一套人法相济、德刑并施,注重从根本、源头上来和谐秩序的社会学说。它不仅是社会和谐理论创制的难点,更是现实为政实践的难点。儒家在此为我们提供了广阔而深厚的精神财富。

Abstract:The codices Ideology of Confucius is not the Theory which the national system set up by Wisdom,and such ideas is no good in public eyes. The Theoretic foundation of The codices Ideology of Confucius based on the thoughtful Apprehend about Humanity, such Theory is a social system Doctrine which the Confucius pay attention to Root,The Theory claim that Law should harmonious with Solon,the ethies and Penalty should be used at the same time in the running of government. Its not only the difficulty of system theory contriving, but also the difficulty of social practice. The Confucius had provided us such genius Treasures thousand years ago.
