非婚同居行为法律规制研究

随着社会的发展和国内外文化的相互渗透,非婚同居作为一种新的两性结合方式悄然兴起。虽然基于道德评判标准非婚同居行为具有不合理性,但从法律视角来看该行为具有合法性与存在的现实性。通过对非婚同居行为的理论研究和法律性质界定,参考国外的立法情况与法律规制,结合我国法律现状和社会实际,明确我国相关立法保障与政策规定,以期为完善我国法律体系、以法律手段规制非婚同居行为、防止损害进一步扩大提供借鉴。

Research on legal regulation of unmarried cohabitation behavior

Along with the development of society and the mutual infiltration of internal and external cultures, unmarried cohabitation emerges quietly as a new kind of sexual combination. Although unmarried cohabitation behavior has irrationality based on moral estimating standard, this behavior has legitimacy and realistic existence from legal perspective. Through theoretical research and definition of legal nature of unmarried cohabitation behavior, the legislative situation and legal regulation abroad are referenced, the legal status quo and social reality in China are combined with, and the related legislative security and policy regulation are clarified, in order to provide references for perfecting the legal system in China, regulating unmarried cohabitation behavior by legal means, and preventing further damages.
