| 摘 要： | 夫妻间相互忠实不仅是婚姻的本质要求,也是我国一夫一妻制的体现。夫妻忠实义务随着网恋现象的增加和＂精神外遇＂导致离婚案件的频发,夫妻忠实义务的内涵也应随之变化,立法应将构成严重危害婚姻关系的＂精神外遇＂纳入违反忠实义务行为之列。我国现行的婚姻法将夫妻忠实义务规定为夫妻的法定义务,可对权利人又否定其通过诉讼获得司法救济的权利,夫妻忠实义务成为不可诉条款。本文通过对新形势下夫妻忠实义务的界定,明确了违反对夫妻忠实义务的公法、私法救济途径,以私法救济为主,有条件的承认夫妻忠实协议的法律效力,对严重违反夫妻忠实义务的行为予以严厉的刑事处罚,构建私法与公法相结合的法律救济途径。
